Terms and Conditions of Sale (Before 2018)
1. Preamble
These Terms and Conditions of Sale govern the contractual relationship between TSUME LTD. whose headquarters are registered at L-5280 Sandweiler, Rolach Industrial Zone (hereinafter referred to as "TSUME LTD.") and its customer.
TSUME SA reserves the right to modify and update these terms and conditions at any time without notice.
By ordering the customer declares to have read these Terms and Conditions of Sale and expressly accept these without reservation.
2. Products
All our products are collectible figurines, not toys, they are for people aged 14 and older.
All parts are manufactured in limited edition.
The figurines offered for sale are those presented on the website of the TSUME LTD. within the limit of available stocks.
Descriptions, information and photographs presenting the figures are the most accurate reproduction possible, but are for illustrative purposes and have no contractual value.
In an effort to constantly improve the quality of its products, the TSUME LTD. may have to have to change the patterns of its products.
3. Preorder-Order
The sale is deemed concluded upon confirmation of the order by the TSUME LTD..
If out of stock, the TSUME LTD. will notify the customer as soon as possible. In which case the order will be canceled and any money paid will be refunded.
For all products marked "pre-order" you have the opportunity to book before its official release. Making a pre-order, the client indicates its intention to order the product before it is available. For these products, the availability date is indicative only.
TSUME SA reserves the right to refuse or cancel any order from a customer in case of unpaid invoices or insolvency.
4. Earnest deposit
Any order implies the payment of a non-refundable deposit equal to 10% of the sale price.
5. Cancellation
The order is voidable by the customer, as the product is not yet shipped. In which case the deposit is not refundable.
TSUME LTD. however, reserves the right to refuse any cancellation request deemed too late, excessive or repetitive.
6. Right of withdrawal
6.1 Products of Tsume Art or Yoka by Tsume
For all orders placed online by internet, the customer has the right to withdraw through writing or on another durable medium, without giving any reason and without penalty, within 14 calendar days, from the date of receipt of product. If the last day of the period is not a business day, the deadline is extended to the next business day.
Upon exercise of the right of withdrawal, the customer will be reimbursed the sums received by the TSUME LTD., including, where appropriate, delivery charges, except for the removal costs and this within 14 days following the date which the TSUME SA was informed of the customer's decision to withdraw. TSUME LTD. however, reserves the right to withhold payment until receipt and verification of the product.
The customer should return the product in perfect condition and in its original packaging at the latest within 14 days following that on which he informed the TSUME LTD. to retract, to the following address: TSUME LTD., TRACOL Building ESTATE SA, Industrial Zone Rolach, L-5280 Sandweiler.
6.2 Product of IKI by Tsume
The customer has a period of 14 days to return, at his expense, the products which do not suit him. This period starts from the date of delivery of the customer’s order. This cancellation right does not bear penalties or costs, except for return shipping costs. If this period expires on a Saturday, Sunday or a holiday, it is extended until the next business day. When exercising the right of withdrawal, the customer has the option of requesting either a refund of money paid, or exchange the product.
In the case of an exchange, the re - shipment will be at the expense of the customer. Any refund will be placed within the best delays and 30 days after in the latest. The returned products must be in their original packaging, with all accessories, in good condition, and accompanied by a copy of the invoice and by the following form HERE.
Items returned incomplete, damaged or soiled by the customer won’t be accepted.
7. Delivery
After confirming the order, all available products are delivered at the latest within 30 days after the day the order is confirmed, subject to full payment.
For pre-ordered, products are delivered as soon as they are in stock. Availability dates indicated on our website are only indicative. The customer will be notified of the delivery date by email.
8. Price
The prices in our catalog are in euros, including all taxes. Delivery costs to Luxembourg and neighboring countries are included.
Shipping fees may be charged for some products to ship to the Luxembourg, France, Belgium and Germany if your order is below 50 euros taxes included. 6
For deliveries to other destinations, shipping costs are expressed by selecting the country of destination. Any customs fees or any other extra fees are to be charge to the customer.
According to article 17.4.b of the law of February 12 1979 amended on February 18 2012, the sale of access tickets of the Tsume Fan Days is subject to the VAT rate in force in the Grand-Duché of Luxembourg, namely 17%.
9. Terms of Payment
The price is due on the day of the order, through secure payment according to the payment methods on our website.
If the payment was refused by the agency of the payment card, the TSUME LTD. automatically proceed to the cancellation of the order. The customer will be notified by email and will have to place a new order.
10. Litigation
This contract is subject to the application of Luxembourg laws. In case of dispute, the courts of Luxembourg are competent.
11. court settlement
If you have difficulties with an online purchase, you have the option to seek an extrajudicial solution through the European platform ODR (Online Dispute Resolution), available at the following link: http://ec.europa.eu/odr /.
12. Protection of personal data
When ordering, the customer accepts that TSUME LTD. handles, collects and makes use of personal information.
The collection of this information is necessary to process orders and payments and the proper conduct of trade relations between the TSUME SA and the customer. These data are not disclosed to third parties.
